Like tens of thousands of men in the American West, Waara was apparently vagging or hitching a ride in an empty box car coupled next to a munitions car in a freight train between Three Forks and Harowton, Montana, when he was discovered in late May or early June 1918 by the conductor and the brakeman. According to the conductor, T.A, Fairhurst, he ordered Waara to leave the car. Waara, he testified, cursed and abused the men and said, 'Americans are no good, and I hope Germany will win the war. For that he was arrested, tried and convicted of sedition in Bozeman, the county seat of Gallatin County under Montana's draconian sedition law, which punished any criticism of the government. A jury found him guilty after 20 minutes of deliberation and the judge sentenced him to 1.5 to 3 years in prison. He served 11 months and was paroled on May 11, 1919.  
 
We do not yet know what he did before this encounter or between then and his death.
